If a digital signature is applied to the root of the Domain Name System, end-to-end assurance of the data is possible. Concrètement, un registrar n'est donc pas plus censé qu'auparavant envoyer des mails pour proposer l'enregistrement de noms de domaine !
Une autre disposition ne pourra être utilisée dans les cas de slamming, car elle concerne la fourniture de produits, alors que l'enregistrement de noms de domaine est une prestation de services : il est désormais interdit "d'exiger le paiement immédiat ou différé de produits fournis par le professionnel sans que le consommateur les ait demandés" (L. 122-11-1 6°).

Three character domain name leads sales chart for Sedo this week.
Domain brokerage Sedo has sold JTR.com for 60,000 EUR, or about $90,000. This is a solid three character domain name with many acronyms.
Sedo also concluded a good Great Domains sale, Doctor.net for 21,760 EUR.
La loi "Chatel" du 3 janvier 2008 avait modifié les dispositions relatives à la publicité mensongère, pour évoquer désormais les pratiques commerciales trompeuses. Un nouvel article du code de la consommation (L. 121-1-1) est créé par la loi de modernisation de l'economie, pour préciser ce que sont ces pratiques commerciales trompeuses. Cet article est applicable aux pratiques qui visent tant les consommateurs que les professionnels. Il interdit notamment : - « Pour un professionnel, de se prétendre signataire d'un code de conduite alors qu'il ne l'est pas" (L. 121-1-1 1°). C'est l'hypothèse d'un registrar qui annoncerait se plier au code de conduite EURid, alors qu'il n'en est pas signataire - "D'afficher un certificat, un label de qualité ou un équivalent sans avoir obtenu l'autorisation nécessaire" (L. 121-1-1 2°). Ce serait le cas par exemple d'un registrar qui se prévaudrait de l'accréditation ICANN alors qu'il ne l'a pas - « (...) ne pas respecter les conditions de l'agrément, de l'approbation ou de l'autorisation reçue" (L. 121-1-1 4°). Naît ainsi une possibilité pour le client d'un registrar de lui opposer les normes contenues dans l'agrément que lui a donné le registre [sauf à supposer qu'un tel agrément, de source privée, ne soit pas considéré comme entrant dans le champ du texte] - « De s'engager à fournir un service après-vente aux consommateurs avec lesquels le professionnel a communiqué avant la transaction dans une langue qui n'est pas une langue officielle de l'Etat membre de l'Union européenne dans lequel il est établi et, ensuite, assurer ce service uniquement dans une autre langue sans clairement en informer le consommateur avant que celui-ci ne s'engage dans la transaction" (L. 121-1-1 8°). Les registrars qui ont des clients à l'étranger devront mesurer les conséquences de cette nouvelle disposition légale... - « De décrire un produit ou un service comme étant " gratuit ?, " à titre gracieux ?, " sans frais ? ou autres termes similaires si le consommateur doit payer quoi que ce soit d'autre que les coûts inévitables liés à la réponse à la pratique commerciale et au fait de prendre possession ou livraison de l'article" (L. 121-1-1 19°). En soi, cette disposition invite les registrars à ne pas faire de promotion du type "votre nom de domaine gratuit", mais "votre nom gratuit pendant un an" - « D'inclure dans un support publicitaire une facture ou un document similaire demandant paiement qui donne au consommateur l'impression qu'il a déjà commandé le produit ou le service commercialisé alors que tel n'est pas le cas" (L. 121-1-1 20°). The first federal court review of open source software licenses was recently undertaken by the U.S. Court of Appeals for the Federal Circuit. The decision, Jacobsen v. Katzer (docs/jacobsen.pdf), No. 2008-1001, slip op. (Fed. Cir. Aug. 13, 2008), is important because it finds that infringers of open source licenses are subject to Copyright laws, as opposed to only being in breach of contract for a violation of an open source license.
The court determined that the “conditions” of the open source license were violated when the Defendant removed some of the license notices and other non-critical portions of the software. This was different from the “covenants” that are violated under a contract analysis.
Why does it matter? Remedies for breaching a contract are generally more limited, usually to the economic losses of a contractor. Violations of federal copyright laws, however, provide for more substantial remedies. Such remedies include statutory damages, infringer profits obtained as a result of the breach and other damages that would be more substantial than the aggrieved party’s economic loss.
This result is important, perhaps critical, to the open source movement. Had the court concluded that violations of open source licenses were simply breaches of contract violators would use open source software with virtually no liability concern. The reason? Open source copyright holders would virtually never be able to show “classic” economic loss, because their software is generally provided for free.
While a boon for open source authors, the opinion does create a problem for business and industry that may have taken liberties with open source licenses in the past. While always a good idea, now is a sensible time for IT departments to do an audit of its software licensing, both as to open source and more traditional (closed source) software packages to ensure compliance.
